Neal was born in Chicago, Illinois to parents who originally hail from India and immigrated to the US. He attended Loyola Academy in Wilmette, Illinois for high school before enrolling at Dartmouth College, where he earned a bachelor’s degree in government and Indian history in 1991. He then enrolled at Yale Law School, where he was mentored by American legal academics Akhil Amar and Bruce Ackerman. In 1995 and 1996, he collaborated with them to publish legal review papers and political opinion periodicals. He was also the ‘Yale Law Journal’s’ editorial director. He did summer internships in Vice President Al Gore’s office and the Solicitor General’s office while in law school. For his third internship, he worked at Washington’s leading law firm, Hogan & Hartson.
Career
President Bill Clinton asked him to submit a report on the need for additional pro bono legal work. He developed special counsel regulations in 1999, which influenced Mueller’s investigation into the Russian government’s efforts to meddle in the 2016 presidential election. He also co-counseled Vice President Al Gore in Bush v. Gore and represented the deans of the majority of major private law schools in Grutter v. Bollinger. Katyal was selected Grand Prize Litigator of the Year for 2016 and 2017 by American Lawyer Magazine in 2017. Katyal has come under fire for writing anti-union filings in two Supreme Court cases, Janus v. AFSCME and Epic Systems Corp. v. Lewis. Hogan Lovells, Katyal’s employer, described Katyal’s accomplishment in these cases as a “major win for the firm.”
In 2020, Katyal defended Nestle and Cargill at the Supreme Court in NestlĂ© USA, Inc. v. Doe, a class-action complaint brought by formerly enslaved children kidnapped and forced to work on cocoa estates in the Ivory Coast. In 2021, Katyal assisted financial behemoth Citigroup in its quest to reclaim a $900 million erroneous transfer to Revlon Inc. creditors. Katyal also assisted the prosecution team in State v. Chauvin. Katyal argued for the respondents in Moore v. Harper, a case involving electoral law, redistricting, and the independent state legislative doctrine, before the Supreme Court in 2022. By a 6-3 majority, the court rejected the autonomous legislature thesis and so affirmed Katyal’s position. In 2022, Katyal defended Johnson & Johnson in a civil dispute in which the business was accused of distributing carcinogenic talcum baby powder. His hourly rate was $2465 for this project.
